Terms of Service

These terms dictate the legal boundaries of resource consumption, account registration, system maintenance, and SLA compensation schemes when renting infrastructure nodes from Votion Cloud.

1. Acceptance of Terms

USAGE_CONTRACT_V1
By provisioning virtual private servers (VPS), dedicated game servers, or networking nodes on the Votion Cloud network, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and the Votion Cloud Ecosystem.

2. Acceptable Use Policy (FUP)

RESOURCE_THRESHOLD_LIMIT
Our shared virtualization clusters operate on a Fair Use Policy. The following activities are strictly prohibited and will result in immediate termination: cryptocurrency mining, running outbound DDoS scripts, hosting malware, spam relays, and running automated web crawlers that saturate hypervisor CPU nodes. Bandwidth limit excess is throttled, not charged.

3. Cryptographic Security & Keys

SSH_KEY_VERIFICATION
Users are fully responsible for securing their server instances, SSH keys, login passwords, and API credentials. Votion Cloud staff will never ask for your root server passwords. Any exploit originating from a customer instance due to poor key management will be isolated immediately.

4. Network Mitigation & Filtering

LUNARSHIELD_MITIGATION
Votion Cloud reserves the right to run traffic filtering and DDoS mitigation dynamically through our LunarShield v4 network edge. In extreme cases where an instance receives a DDoS attack exceeding 500 Gbps that impacts adjacent node tenants, we reserve the right to null-route the IP address temporarily.

5. Service Level Agreement (SLA)

99.99_PERCENT_UPTIME
We guarantee a 99.99% monthly network uptime for all premium VPS and Bare-Metal nodes. In the event of hypervisor failure or power losses causing downtime below the threshold, customers are eligible for pro-rated account credits in accordance with our SLA compensation index.

6. Legal Jurisdictions & Governing Law

Our infrastructure services comply with country-specific regulatory frameworks as follows: • United States (USA): Terms conform to CCPA/CPRA consumer data opt-outs, CalOPPA compliance, COPPA restrictions (no users under 13), and CAN-SPAM requirements. • European Union (EU) & Germany (DE): Services conform to GDPR standards, ePrivacy Directive, and German TDDDG directives. DE users have the right to request comprehensive contract logs. • United Kingdom (UK): Aligned with the UK GDPR and the Data Protection Act 2018 (DPA 2018) regulations. • Japan (JP): Governed by the Act on the Protection of Personal Information (APPI) for cross-border infrastructure transit. • India (IN): Compliant with the Digital Personal Data Protection Act (DPDPA 2023), recognizing customer rights as Data Principals. • Singapore (SG): Regulated under the Personal Data Protection Act (PDPA 2012) governing server access controls.
